SEVILLA, 22.5.2019 (EUROPA PRESS).- El jurado popular ha declarado culpable de asesinato a J.M.R.M., el hombre acusado de matar a su ex pareja sentimental en el mes de octubre de 2016 en la localidad sevillana de Olivares, durante la lectura del veredicto producida este martes en la Audiencia Provincial de Sevilla.
El jurado considera por unanimidad como probado que en el día de autos el acusado se trasladó en coche al lugar donde trabajaba su ex pareja para recoger a los hijos en común y que de manera sorpresiva sin que diera lugar a la víctima a defenderse, cogió a su ex por los pelos para tirarla y ponerse encima para asestarle hasta doce puñaladas con un cuchillo, el cual había cogido previamente con la intención de acabar de su vida, mientras los menores estaban presentes a pocos metros del lugar de los hechos.
Asimismo, el jurado considera probado que el acusado mantuvo una relación sentimental con la víctima y fruto de la misma nacieron sus dos hijos en común. Igualmente, señala como hecho probado que durante la relación, que se inició en el país de ambos, la República Dominicana, J.M.R.M. se comportaba de manera controladora y humillaba a la víctima, situación que se agravó cuando se fueron a vivir en 2012 a la localidad aljarafeña de Olivares.
Continuando esa línea, el jurado indica como probado que la relación se fue empeorando hasta el punto de que, en febrero de 2016, el procesado la amenazó con un cuchillo por no querer mantener relaciones sexuales y, en septiembre de ese mismo año, le recriminó que sospechaba de que estuviera con otra persona y le golpeó varios puñetazos a lo que la víctima se defendió arañándole la cara.
De igual modo, el jurado considera probado que el encausado ejercía un tremendo control de su ex pareja comprobando hasta su ropa interior por si tenía flujo lo que refleja un clima de terror y un dominio absoluto hacia la víctima. Así, el jurado popular señala que concurre la circunstancia agravante de género, siendo la primera vez que se contempla ese tipo de agravante en un juicio en la provincia de Sevilla.
Además, el jurado considera probado que el acusado ejercía la violencia física y psíquica en el ámbito familiar.
Por otra parte, el jurado popular no considera probado que el acusado, quien tras el incidente montó a los niños en el coche para dirigirse a Utrera para dejar a los menores con su madre hasta que fue interceptado en Salteras por la Guardia Civil, no se entregó voluntariamente ni confesó los hechos ni colaboró en la reconstrucción del suceso. Igualmente, tampoco considera probado que en el día de los hechos, J.M.R.M. actuara bajo un sentimiento de angustia producido por una preocupación hacia sus hijos que desde octubre de 2016 podían esta conviviendo con la nueva pareja sentimental de su madre que presuntamente está relacionado con los estupefacientes.
Por ello, el jurado ha desaconsejado, dadas las circunstancias del caso, que se le conceda al encausado la suspensión de la pena, así como el indulto total o parcial.
Con todo, la Fiscalía ha mantenido su petición de 25 de años de prisión para el acusado por un delito de asesinato con agravante de parentesco y género y de tres años de cárcel por un delito de violencia habitual en el ámbito familiar. Además, ha solicitado que se le imponga una indemnización total de 150.000 euros a los hijos de la víctima, de 40.000 euros a la madre y de 20.000 euros al hermano de la misma. Igualmente, reclama que se le retire la patria potestad respecto a sus hijos y que se le imponga la medida de libertad vigilada por un periodo de diez años.
Por su parte, la acusación particular que ejercen por un lado, la Junta de Andalucía, y por otro la familia de la víctima ha pedido que se condene al encausado a 30 años de prisión.
Por último, la defensa del acusado ha cambiado su petición de cárcel para el acusado, cambiando de los cuatro años que pedía para su representado por un delito de homicidio imprudente a los 20 años y un día de cárcel por un delito de asesinato y una condena de seis meses un delito de violencia habitual en el ámbito familiar al apuntar que “no ha quedado acreditado” que los menores hayan visto esos episodios violentos. Igualmente, ha solicitado que la patria potestad esté suspendida en un periodo un año superior a la pena privativa de libertad y que la medida de libertad vigilada no supere los cinco años.
